Public Hearings


The Cape Coral Code Compliance Division aims to gain voluntary compliance with the city's codes and ordinances through cooperation from property owners where violations exist.  However, some property owners choose to disregard the city’s codes and ordinances, which then require an escalation of enforcement to a hearing before Cape Coral’s Special Magistrate.

The City of Cape Coral conducts code enforcement hearings pursuant to Florida Statutes Title XI, Chapter 162.  The City of Cape Coral uses a Special Magistrate to preside over the hearings as stipulated in Chapter 162.03(2), which states:

A charter county, a non-charter county, or a municipality may, by ordinance, adopt an alternate code enforcement system that gives code enforcement boards or special magistrates designated by the local governing body, or both, the authority to hold hearings and assess fines against violators of the respective county or municipal codes and ordinances. A special magistrate shall have the same status as an enforcement board under this chapter.  References in this chapter to an enforcement board, except in s. 162.05 shall include a special magistrate if the context permits.

Code compliance hearings for the City of Cape Coral are open to the public.  The hearings are held in the City of Cape Coral Council Chambers (second floor) located at 1015 Cultural Park Blvd, Cape Coral, FL.  The hearings start at 9:00 am and continue until all cases on the docket have been heard.

In accordance with the Americans with Disabilities Act and Section 286.26, Florida Statutes, persons with disabilities needing special accommodation to participate in the hearings should contact the Office of the City Clerk at least forty-eight (48) hours before the date of the hearing.
